Terms & Conditions

Please read these Terms carefully before engaging Nusantara Counsel's services.
1. Definitions
- "Agreement" means these Terms & Conditions together with any engagement letter or service confirmation issued by us.
- "Service" means the immigration advisory and application support services provided by Nusantara Counsel.
- "We / Us / Our" refers to Nusantara Counsel, registered and operating in Singapore.
- "You / Client" refers to the individual or company engaging our services.
- "Authorities" means the Ministry of Manpower (MOM), Immigration & Checkpoints Authority (ICA), or other relevant Singapore government agencies.
2. Acceptance of Terms
By submitting an enquiry form, signing an engagement letter, or proceeding with a service after receiving a fee quote, you confirm that you have read and accept these Terms. Our services are available to individuals who are 18 years of age or older and have the legal capacity to enter into a binding agreement.
3. Service Description
Nusantara Counsel provides advisory and application support services in connection with Singapore immigration matters. Services include, but are not limited to:
- Employment Pass (EP) application support and renewal assistance
- Permanent Residency (PR) profile assessment and application preparation
- Dependent Pass (DP) and Long-Term Visit Pass (LTVP) processing
- Appeal preparation following rejected applications
Services are available to clients within Singapore and internationally, where permissible. All services relate to Singapore immigration matters.
4. Client Responsibilities
Clients are responsible for:
- Providing accurate, complete, and current information and documents as requested
- Promptly notifying us of any changes in employment, personal circumstances, or pass status
- Reviewing all materials prepared by us before authorising submission
- Meeting any deadlines communicated by us or the Authorities
- Ensuring that all declarations submitted to the Authorities are truthful
We are not liable for outcomes arising from inaccurate, incomplete, or untimely information provided by the Client.
5. Intellectual Property
All content on our website, including text, design, and structure, is the property of Nusantara Counsel. You are granted a limited, non-exclusive licence to access the website for personal, non-commercial purposes. You may not reproduce, distribute, or adapt our content without prior written consent.
6. Payment Terms
Service fees are stated in Singapore Dollars (SGD) and confirmed at the start of each engagement. Payment terms are as follows:
- Fees are payable in advance of work commencing unless otherwise agreed in writing
- Payment methods include bank transfer and credit card where available
- Fees are non-refundable once documentation preparation or submission has commenced
- Refund requests before work commences will be assessed on a case-by-case basis
All fees are exclusive of government filing fees, translation costs, and other third-party disbursements, which are billed separately where applicable.
7. Service-Specific Terms
Employment Pass: Submission timelines are subject to MOM processing periods. We do not control processing outcomes. Our service covers preparation and submission, not outcome.
Permanent Residency: ICA PR review timelines vary and are not within our control. We provide assessment and preparation support. No assurance of outcome is made or implied.
Dependent Pass / LTVP: Eligibility is subject to the main pass holder's status and MOM's assessment. Our service covers documentation and submission. Outcomes remain subject to MOM's discretion.
8. Disclaimers
Our services are provided on a best-efforts basis. We do not represent or imply that any application will be approved. Immigration decisions are made solely by the relevant Singapore government authority.
Information provided through our website is for general reference only and does not constitute legal advice. Specific advice is provided only within the scope of a confirmed client engagement.
9. Limitation of Liability
To the extent permitted by Singapore law, Nusantara Counsel's liability is limited to the fees paid by the Client for the specific service in respect of which a claim arises. We are not liable for indirect, consequential, or incidental losses, including losses arising from application delays or adverse decisions by the Authorities.
10. Confidentiality
We treat all client information as confidential. Information shared with us in the course of an engagement will not be disclosed to third parties except as required for the delivery of services or by law. Please refer to our Privacy Policy for full details.
11. Termination
Either party may terminate an engagement by written notice. If you terminate after work has commenced, fees already incurred for completed stages will remain payable. We reserve the right to terminate an engagement if a client provides false information, fails to cooperate, or if continued engagement would conflict with applicable law.
12. Dispute Resolution
These Terms are governed by the laws of Singapore. In the event of a dispute, the parties agree to seek informal resolution in the first instance by contacting us at the details below. If informal resolution is not achieved within 30 days, disputes will be subject to the exclusive jurisdiction of the Singapore courts.
13. General Provisions
- These Terms constitute the entire agreement between the parties unless supplemented by a written engagement letter.
- If any provision is found unenforceable, the remaining provisions continue in full force.
- Our failure to enforce any right does not constitute a waiver of that right.
- We may update these Terms at any time. Continued use of our services after an update constitutes acceptance.
